Cold Car USA Warrants to the Buyer:
- The freezer body shall be free of defects in material and workmanship under normal use and service for a period of three years from the date of delivery. Cold Car USA’s sole obligation under this warranty shall be limited, at its option, to either repair or replace the freezer body if determined by Cold Car USA to be defective.
- Parts on and within the freezer body shall be free of defects in material and workmanship under normal use and service for a period of one year from the date of delivery. Cold Car USA’s sole obligation under this warranty shall be limited, at its option, to either repair or replace the part or parts if determined to be defective by Cold Car USA.
- The compressor shall be free of defects in factory workmanship and material under normal use and service for a period of one year from the date of delivery. Cold Car USA’s sole obligation under this warranty shall be to replace the compressor with one of like kind and quality or similar design and capacity if determined to be defective by Cold Car USA.
Warranty Limitations and Exclusions:
- Cold Car USA shall only be responsible for labor costs including but limited to labor costs required to analyze the condition of the unit, its parts and compressor, and/or labor incurred in the repair or replacement of any of the aforementioned for a period of 90 days from the date of delivery for parts and 365 days for compressor.
- Cold Car USA’s obligation under the compressor warranty does not apply to the control relay fan or any electrical component. Cold Car USA is not responsible for any labor or labor cost in replacing the compressor, heat exchanger, or replaceable parts of the unit.
- Cold Car USA shall not be responsible for transportation or incidental costs incurred in connection with the repair or replacement of the unit, any of its parts or the compressor.
- Cold Car USA shall not be responsible for a freezer body, parts or compressor, upon which inspection, are determined by Cold Car USA to have been subjected to misuse, neglect, alteration, accident, abuse, damage during transit or delivery or by fire, flood or acts of God.
- Cold Car USA shall in no event be liable for special, indirect, or consequential damages, including but not limited to food or product spoilage claims, loss of use, or for any delay in the performance of this warranty due to causes beyond its control.
General Provisions
The Warranty shall apply only to the product sold and used within the boundaries of the Continental United States, Alaska and Hawaii.
Buyer may file warranty claims directly with Cold Car USA within ten days of the occurrence. All claims must be supported by information concerning the alleged defect and specifically identified by the serial number of the body, part or compressor and purchase date.
THERE ARE NO OTHER WARRANTIES EXPRESSED, IMPLIED OR STATUTORY, EXCEPT THIS WARRANTY, WHICH IS IN LIEU OF ALL OTHER WARRANTIES INCLUDING TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
